My Support For Open & Early Discovery Of Evidence

Did you know that New York State is in company with a few really conservative states that permit District Attorney’s to withhold evidence against an accused at time of arraignment? This allows for many innocent people to go to jail, or to plea bargain to lesser charges for something that they did not do. This is an issue that very few people have payed attention to because it is entwined in the complicated Judicial System that few common folks deal with except as victims, or family of victims.

However, this unjust issue is finally coming out of the shadows and being exposed in our community thanks to the volunteers of an organization called, Discovery For Justice that I am proud to be a co-founder and member of its executive committee.

Our goal is to change the Criminal Procedure Law (CPL) 240 and change it with CPL 245 a law that will allow District Attorneys to provide all relevant evidence at time of arraignment, thus allowing defendants to better defend themselves if innocent and not waste the courts time if guilty. For this law to change it has to occur by passing state legislation and unfortunately, though it has been passed in the Assembly where Democrats have had a majority, it has been held up in committee in the Senate.

Our goal is during this period of a year end legislative session to get this issue to governor Andrew Cuomo where he can by executive order introduce the legislation and get it passed during this special session where negotiations and deals will be can get this law passed.

Help us, call, or write to the governors office and tell him that you would like him to support “Open and Early Discovery in New York State’s criminal justice system.” Help pass CPL 245!
